The second generates the most questions and is the least taught in any instructor or physiotherapist course.

We’ve compiled the 10 most frequently asked questions by those managing this type of center in Spain, with answers based on official sources and proven industry practices. From what paperwork you need to open to how to organize your schedule without going crazy.

1. What do I need to legally open a fitness, Pilates, or yoga center in Spain?

For premises up to 300 m² dedicated to an activity considered low-risk (without significant environmental or health impact), Law 12/2012 and Law 20/2013 on guarantee of market unity allow opening with a simple responsible declaration or prior notification: you submit the documentation and the city council inspects afterward, rather than before. That 300 m² threshold and the exact criteria may vary by municipality, so it’s worth confirming with your specific administration. If the premises are larger or the activity is classified as higher risk, a traditional activity license is required, with a technical project and prior inspection.

Added to this is registration with RETA (for self-employed) or as a company, tax registration with the Treasury (form 036/037), and the corresponding IAE code: 967.1 for sports facilities (gyms) or 967.2 for sports schools and services (Pilates or yoga classes). Liability insurance is not always mandatory under national law, but several autonomous communities do regulate it for physical-sports activities, and in practice almost no city council grants a license without it.

Special case: physiotherapy. As a regulated health activity, you also need mandatory registration with your professional association and registration of the center in the Registry of Health Centers, Services, and Establishments of your autonomous community.

2. Is time tracking mandatory for my employees?

Yes, without exceptions by size. Royal Decree-Law 8/2019 has required since May 12, 2019 that all companies—including yours if you have just one hired professional—record daily the exact start and end time of each employee’s workday, not just total hours worked.

The law does not mandate a specific program, but it does require that the record be objective, reliable, and always accessible to the worker and the Labor Inspectorate. Furthermore, if the latest amendments to the law are ultimately approved, requirements in this regard will increase. A paper or Excel sheet will no longer be sufficient. The goal is for the system chosen by the company to guarantee that the time record cannot be modified once signed by both parties.

Not keeping it, or keeping it in a manipulable way, is considered a serious infraction and can result in fines between €751 and €7,500.

3. What should I know about data protection (GDPR) at my center?

If your center collects physiotherapy records, nutritional plans, or physical assessments with health data (injuries, pathologies, heart rate), you are processing special category data under Article 9 of the GDPR. This requires explicit consent (implicit consent sufficient for a simple email is not enough) and enhanced security measures.

In practice, this translates to: clearly informing your clients what data you collect and why, maintaining a Record of Processing Activities, signing data processor agreements with your technology providers (including booking software), and reporting any security breach to the AEPD within 72 hours. The Spanish Data Protection Agency offers a free tool, Facilita RGPD, designed precisely for SMEs that need to comply without hiring a specialized firm.

Appointing a Data Protection Officer (DPO) is not mandatory for the entire sector: it is mandatory for health centers that maintain complete medical records (physiotherapy, for example), not necessarily for a Pilates or yoga studio without that level of record-keeping. A real warning: the AEPD has already sanctioned gyms for requesting biometric data (fingerprints) for access control without sufficient justification, when less invasive alternatives exist.

4. What is Verifactu and how does it affect my center’s invoicing?

Verifactu is the Tax Agency’s electronic invoicing system, mandatory throughout Spain except in the Basque Country (where its regional equivalent, TicketBAI, applies). It requires that your invoicing software generate each invoice with an unalterable and traceable fingerprint, and be able to send those records to the Treasury.

As of July 2026, Verifactu is not yet mandatory: following Royal Decree-Law 15/2025, the deadline was extended to January 1, 2027 for companies and July 1, 2027 for self-employed. That said, it’s worth checking as soon as possible whether your management software is already adapted—tools like TIMP already include Verifactu and TicketBAI integrated as standard—so you don’t have to change systems under pressure in the final quarter before the deadline.

You can see how different sector software positions itself regarding this regulation in our article “Software for Pilates centers: 2026 comparison.”

5. Packages, monthly memberships, or drop-in classes? Which pricing model suits me best?

There’s no single answer: it depends on your type of business and your clientele.

Monthly memberships: Recurring revenue. This can be a traditional gym model where a membership works as an unlimited plan, giving the client a sense of maximum freedom, and you the security of receiving payment even if they don’t attend. But the cancellation risk is high, as if the habit is gradually lost, cancellation comes quickly.
The current trend, both in gyms and especially in Pilates or yoga centers, is to define how many sessions that recurring payment includes and thus force a greater bond and commitment from the client to the service and center.

Class/session packages: sometimes clients cannot or do not want to commit to what a monthly membership requires and prefer to spend a class package over a longer period, even though each class costs them more.

Drop-in classes: provide maximum flexibility and are ideal for attracting new clients who want to try before committing, but generate more irregular income and worse cash flow forecasting if they’re your only model. This could be the case for physiotherapy centers, although this type of business can also build loyalty with packages.

The usual approach is to combine them all. And above all, decide carefully what each type of membership includes, what maximum validity period a package has, etc. These are strategic decisions that must be made with information, not just intuition. That’s why it’s important to cross-reference CRM and Statistics data from a program like TIMP. Knowing your clients well will help you better understand your business and optimize your schedule and space to the fullest.

6. How do I reduce absences and last-minute cancellations?

The most common and recommended practices in the sector are:

Establish a cancellation policy that sets a minimum number of hours before which the client can cancel the session without losing that credit (or with some other penalty).

Send automatic reminders with a booking management program like TIMP, which allows different channels such as push notifications to mobile, SMS, etc.

Charge in advance (with packages or recurring memberships) not allowing booking or enjoying it without having the credit.

Activate automatic waiting lists so that the free spot is filled when someone cancels.

Allow (or even impose as the usual payment method) payments through the app (like TIMP’s app), making it easy for the client to pay from the same mobile they use to book.

With all these practices, centers with big data accessible via TIMP reduce cancellations by at least 30%.

7. How do I retain my clients and reduce churn?

According to IHRSA, half of a gym’s new members leave within the first 6 months. The HFA 2025 Fitness Industry Benchmarking report, with data from more than 175 companies and 17,000 facilities in 27 countries, places the sector’s average annual retention at 66.4%, compared to 71.4% recorded a decade ago: retention has fallen, not risen.

What works best, according to the same type of industry sources: personalized communication from the team (a staff interaction with the client is associated with one more visit the following month), the sense of community, and above all early frequency: clients who attend two or more times per week are half as likely to cancel as those who go once or less.

Detecting early who has stopped coming—something that management software like TIMP can automatically flag by drop in attendance—gives you room to act before the cancellation becomes irreversible.

8. Do I need management software or is Excel and WhatsApp enough?

If you have a handful of regular clients and you teach all the classes yourself, an Excel sheet and a WhatsApp group can hold up for a while. The problem appears when you grow a bit: each WhatsApp booking is a message that must be read, confirmed, and noted. Each schedule change means notifying, and each cash payment is an entry that someone has to transfer somewhere so it squares with the Treasury. A hassle that doesn’t let you focus on your work and consumes time and energy.

Management software like TIMP centralizes that: 24/7 bookings without you having to watch your phone, automatic payments, capacity control and waiting lists, invoicing already adapted to Verifactu, CRM and Statistics data, and different communication tools.

It’s not a question of minimum business size, but rather at what point the time you dedicate to administration (on repetitive tasks that don’t help you grow as a business either) starts to outweigh what you dedicate to your clients.

9. Do I need my own app for clients or is booking via social media or WhatsApp sufficient?

It depends on how many bookings you manage and what your clients expect. Booking via Instagram or WhatsApp works while volume is low, but it has a clear limit: you can only handle messages when you’re available, and outside your hours (at night, on weekends) those bookings are left waiting for you to see them.

A booking app—like TIMP Bookings, designed for clients to book, cancel, or check their package from their mobile at any time—shifts that management outside your service hours without you having to be behind it. For the client, it also conveys a more professional image than signing up in a group chat shared with other students.

10. How do I manage multiple locations or multiple professionals without losing control?

The multi-location challenge is not just having more schedules: it’s not losing the overall view. When each location runs its own organization, knowing what occupancy each center has, who has paid and who hasn’t, or which professional has free slots means calling or asking, location by location. Sometimes information gets stuck and you can’t optimize your resources to improve the whole.

Centralized management dashboards—TIMP distinguishes organization and center precisely for this—allow you to see real-time data from all your locations from a single place, without losing the separation of each one. Before growing to a second location, it’s worth checking whether your current system scales with you or whether you’ll have to duplicate administrative work for each new center you open.

In summary

Most of these questions share the same underlying issue: the more time you spend manually controlling what a system can automate, the less time you have left for what actually grows your center. Not all answers involve software, but several do—and it’s worth reviewing which of these 10 questions hides the biggest bottleneck in your business today.

If you want to see how TIMP solves several of these issues at once—bookings, time tracking, electronic invoicing, and multi-location in a single dashboard—you can try it free with no commitment.

Consulted Sources

Opening and licenses: BOE — Law 12/2012, BOE — Law 20/2013, BOE — RD 1277/2003, COLEF Council — IAE

Time tracking: BOE — RDL 8/2019, Work day recording guide — Ministry of Labor

GDPR: AEPD — Facilita RGPD

Verifactu/TicketBAI: AEAT — deadline extension information note

Absences and reminders: Systematic review on appointment reminders — PMC

Retention and loyalty: EuropeActive/Deloitte 2025 Report

Management and booking software: timp.pro

Licenses, time tracking, GDPR, Verifactu, pricing, no-shows, retention, and software: everything asked by those managing a training, Pilates, yoga, or physiotherapy center in Spain.
